Terms of Service

1. Agreement to these Terms
By creating an account, using TheOarShop, uploading an OAR, offering an OAR for sale or free distribution, purchasing marketplace content, or otherwise using the service, you agree to these Terms and the policies linked from the Legal Center. If you do not agree, do not use the service.
2. User-uploaded OARs and responsibility
TheOarShop is a marketplace and distribution platform for content submitted by users and, in some cases, content imported from third-party sources under stated licenses. Users who upload or list content are solely responsible for what they submit. TheOarShop does not create, endorse, or independently guarantee the ownership, legality, accuracy, safety, or licensing of user-submitted OARs.
3. Your rights warranty when uploading
Every person who uploads an OAR represents and warrants that they own or control all rights necessary to upload, host, distribute, sell, or provide that OAR for free through TheOarShop, or that they have explicit permission or licenses allowing those uses. This applies to the OAR as a whole and to content inside it, including terrain, textures, meshes, objects, scripts, sounds, animations, images, logos, branding, and other protected material.
The upload form requires a separate confirmation of this warranty. TheOarShop records that confirmation with the applicable Terms version and other audit information.
4. License you give TheOarShop
You retain whatever ownership rights you have in your content. By uploading it, you grant TheOarShop a non-exclusive, worldwide license, for as long as the listing or required records remain on the service, to host, store, copy, transmit, display, create marketplace thumbnails or previews from materials you provide, and make the OAR available to users according to the listing type you selected. For Free Public OARs, this includes distribution through public download and direct-load URLs that may be accessed without signing in.
5. Prohibited uploads
You may not upload content that infringes copyright, trademark, privacy, publicity, contractual, or other rights; content you are not authorized to redistribute; malware or intentionally harmful code; deceptive or fraudulent listings; unlawful content; or content that otherwise violates these Terms or applicable law.
6. Copyright complaints and removal
TheOarShop may remove or disable access to content when we receive a valid copyright notice, when infringement is apparent to us, when a license does not permit redistribution, or when we otherwise reasonably believe a listing violates rights or these Terms. We may preserve records relating to removed listings, transactions, upload confirmations, and complaints as reasonably necessary for legal, fraud-prevention, accounting, or enforcement purposes. 7. Repeat infringement
TheOarShop may restrict, suspend, or terminate accounts of users who repeatedly infringe intellectual-property rights or repeatedly upload material they are not authorized to distribute. Serious or deliberate violations may result in immediate action.
8. Marketplace purchases and access
A marketplace purchase grants access to the purchased OAR through the service; it does not transfer copyright or ownership of intellectual property unless the applicable rights holder expressly says otherwise. Removing a paid item from your personal OAR library can require a new purchase to restore access. Free OARs may be re-added while they remain available.
9. Marketplace seller fee
For each paid OAR sale, TheOarShop currently retains 25% of the purchase price as the marketplace fee and the seller receives the remaining 75%. No marketplace sale commission is charged on a Free Public OAR.
TheOarShop may change the marketplace fee at any time by updating the posted rate and/or these Terms. A changed rate applies to sales completed after that rate becomes effective; the marketplace fee in effect when a sale is completed controls that sale. Sellers are responsible for reviewing the current posted fee and may archive or deactivate a listing if they do not wish to continue selling under a changed rate.
Paid OAR listing forms require a separate seller acknowledgment of the marketplace fee. TheOarShop may keep a record of that acknowledgment, including the fee rate and Terms version presented at the time.
10. Featured listings and fees
Featured-listing fees are paid promotional fees. They are non-refundable once charged. If auto-renew is enabled, the same plan may renew when the current period ends if sufficient TOS$ is available. You may disable auto-renew or end Featured placement early, but unused paid time is forfeited.
11. Service availability
The service may change, experience downtime, or discontinue features. We may archive, suspend, restrict, or remove listings or accounts as needed to operate the marketplace, enforce these Terms, respond to legal requests, protect users, or address security and technical issues.
12. Disclaimers and limitation of responsibility
To the fullest extent permitted by law, TheOarShop is provided on an “as is” and “as available” basis. TheOarShop does not warrant that user-uploaded content is non-infringing, error-free, compatible with a particular simulator, or suitable for a particular purpose. Users are responsible for evaluating content before use. Nothing in these Terms excludes responsibility that cannot lawfully be excluded.
13. Indemnity for uploaded content
To the extent permitted by law, an uploader agrees to defend, indemnify, and hold harmless TheOarShop and its operators from claims, losses, liabilities, and reasonable costs arising from the uploader's content, violation of these Terms, or breach of the uploader's rights warranty.
14. Changes to these Terms
We may update these Terms as the service changes. The effective date and version shown above identify the current version. Material changes may also be communicated through the website. Continued use after an updated version becomes effective constitutes acceptance where permitted by law.
15. Governing law
These Terms are governed by Mexico, without regard to conflict-of-law rules, except where applicable law requires otherwise.
